TE Connectivity has received the attached Force Majeure notices from our suppliers DuPont, Ascend, Solvay and Lyondellbasell/Schulman concerning the shortage of raw materials, and we are actively working to learn our supplier’s resulting allocation decisions and determine how those allocations decisions are going to impact our production.
As you are aware our primary goal is to support you under these circumstances to the best extent we can and to maintain our ability to deliver. Given the multiple Force Majeure notes across the supplier base around the globe, a negative impact on our ability to supply is inevitable.
As a result, TE must respectfully advise that these circumstances (i) render TE’s performance practically and/or commercially impossible, and (ii) constitute a Force Majeure event under all applicable agreements between TE and its customers and their respective affiliates. As such, TE will not accept responsibility (including the responsibility for financial costs) for any resulting line-down or other supply chain related charges such as e.g. premium freight.
Please be assured that TE is paying close attention to the situation and is being sensitive to the needs of its customers in the region. We are exploring options to minimize the impact to your supply chain. We are actively looking for available alternatives and please be prepared that we may approach you for urgent decision making, as we need your support in obtaining the required approvals. Please liaise with your TE sales or customer service representatives if your orders have been impacted or are likely to be impacted by this Force Majeure event.
